Privacy Policy of Łyszkiewicz and Partners limited partnership

The purpose of this document is to present the principles on which your personal data are processed and to indicate your basic rights related to the processing of your personal data.

Personal data administrator

The administrator of the personal data is Łyszkiewicz i Wspólnicy spółka komandytowa (“ŁYSZKIEWICZ I WSPÓLNICY”) with its registered office in Warsaw, with its address at Al. Jerozolimskie 53, 00-697 Warsaw.

Personal data collected by ŁYSZKIEWICZ I WSPÓLNICY is processed in accordance with the principles set forth in the data protection regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (“RODO”) and Polish regulations issued in connection with RODO, including the Act of May 10, 2018 on personal data protection.

ŁYSZKIEWICZ I WSPÓLNICY keeps personal data confidential and secures them from unauthorized access by third parties under the terms of the aforementioned legal acts.

Scope and purposes of personal data processing

Your personal data may be processed by ŁYSZKIEWICZ I WSPÓLNICY on the basis of:

(a) the legitimate interest ofŁ YSZKIEWICZ I WSPÓLNICY (Article 6(1)(f) RODO), for:

(i) the conduct of correspondence, where the legitimate interest of ŁYSZKIEWICZ I WSPÓLNICY is to conduct correspondence addressed to the sender in connection with the business conducted by ŁYSZKIEWICZ I WSPÓLNICY,

(ii) marketing ŁYSZKIEWICZ I WSPÓLNICY’s own products and services, including for analytical purposes, where the legitimate interest of LYSZKIEWICZ I WSPÓLNICY is to conduct direct marketing of its own products and services,

(iii) asserting or defending against possible claims, where the legitimate interest of ŁYSZKIEWICZ I WSPÓLNICY is to assert or defend claims.

(b) contract or to take action prior to its conclusion (Article 6 (1) (b) RODO) for the purpose of performing the contract between ŁYSZKIEWICZ I WSPÓLNICY and the data subject or to take action prior to its conclusion,

(c) to recruit persons interested in cooperation with ŁYSZKIEWICZ I WSPÓLNICY (Article 6(1)(c) and Article 6(1)(a) of the RODO).

(d) ŁYSZKIEWICZ I WSPÓLNICY also processes personal data in the scope of fulfilling legal obligations incumbent on ŁYSZKIEWICZ I WSPÓLNICY (legal basis art. 6.1.c RODO).

Rights regarding personal data

Right of access to data – you have the right to obtain information regarding the personal data held by LYSZKIEWICZ AND PARTNERS about you, including a copy of such data.

Right to rectification of data – you have the right to request the rectification of your personal data that is inaccurate. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by providing an additional statement.

Right to erasure – you have the right to request the deletion of your personal data stored by us in the following cases:

(a) your personal data is no longer necessary for the purposes for which it was collected,

b) you have raised an objection to the processing and there are no overriding legitimate grounds for the processing, or the objection relates to processing for direct marketing purposes,

(c) the personal data were processed unlawfully,

d) the personal data must be deleted in order to comply with a legal obligation under Union or national law,

e) the personal data was collected in connection with the offering of information society services referred to in Article 8(1) of the RODO.

Right to data portability – you have the right to receive in a structured, commonly used machine-readable format personal data concerning you that you have provided to us, if the processing of such data is based on consent or contract and by automated means. If you request that this data be sent to another data controller, this will be done, as long as it is technically possible.

Right to restrict processing – you have the right to request that the processing of your personal data be restricted if:

  • you question the accuracy of your personal data – for a period that allows us to check the accuracy of the data,
  • the processing is unlawful, and you object to the deletion of the personal data, requesting instead a restriction on its use,
  • we no longer need the personal data for the purposes of processing, but you need them to establish, assert or defend claims,
  • you have lodged an objection under Article 21(1) of the RODO to the processing – until it is determined whether the legitimate grounds on the part of ŁYSZKIEWICZ i Wspólnicy override the grounds for the objection.

Right to object to processing – if your personal data is processed on the basis of a legitimate interest of the controller, you have the right to object at any time to the processing, pursuant to Article 21 RODO.

The right to lodge a complaint

You have the right to lodge a complaint related to the processing of your personal data by ŁYSZKIEWICZ i Wspólnicy to the President of the Office for Personal Data Protection.

Processing period

Your personal data will be processed, respectively:

(a) until the expiration of the limitation periods related to the contract to which the processing of your personal data is related;

(b) until the relevant legitimate interests pursued by LYSZKIEWICZ i Wspólnicy as Data Controller related to the processing of certain data are realized;

(c) until the expiration of time limits related to the statute of limitations for obligations under the law;

d) until such time as an objection is made or consent is withdrawn with respect to the processing of data for marketing purposes.

Transfer of personal data to other entities

Recipients of your personal data may be, in particular, external service providers (e.g. IT service providers and entities processing data on behalf of LYSZKIEWICZ I WSPÓLNICY on the basis of a contract for entrustment of personal data processing), accountants, auditors, lawyers, administrative authorities, state services and courts.

Your data is processed only by entities located within the European Economic Area. The transfer of data to third countries is not currently practiced or planned by us.

LYSZKIEWICZ I WSPÓLNICY, in connection with its cooperation with its suppliers and other law firms, may entrust the processing of your personal data to the entities indicated above. However, in each case, these entities will be obliged to maintain the confidentiality of your personal data and to process them in accordance with data protection regulations and the relevant instructions of LYSZKIEWICZ I WSPÓLNICY.

Profiling

Your personal data is not subject to profiling as one of the forms of automated processing of personal data.

Change of Privacy Policy

ŁYSZKIEWICZ i Wspólnicy reserves the right to make changes to the Policy at any time. Such changes will be published on lyszkiewicz.pl and will be effective only for the future.
